Drawing on history, philosophy, and economics, this class examines questions such as why society enforces promises and the limits of freedom of contract. The goal is to deepen students' understanding of contract law by showing how its doctrines implicate fundamental debates over the organization of society. Class discussions cover "hard cases" such as surrogacy contracts, organ sales, contracts of adhesion, etc. in addition to scholarly writings.
