This seminar examines the difficult decisions that prosecutors and defense attorneys make. The process of decision-making is impacted by the prosecutor’s duty to assure that justice is achieved and the defense attorney’s obligation to aggressively represent a sometimes unattractive client. The ethical dilemmas of the criminal law practitioners are emphasized throughout the course. The class will include these topics: 1) decision to charge; 2) granting immunity; 3) discovery and Brady issues; 4) lawyer-client relationship; 5) duty to investigate; 6) plea bargaining; and 7) decisions made by criminal defendants. We will use the ABA Standards for Criminal Justice: Prosecution and Defense Function, 3rd ed. as a guide. Handouts will be provided by the instructor.
The Fall 2005 class will be held on the following Mondays from 4:30 PM to 6:10 P.M.; August 22, September 5, and 19, October 3 and 24 and November 14 and 28, 2005. The course will be graded for one credit hour and will require a paper of approximately 10 pages.
