Curriculum

LAW 582-01 International Bioethics and Health Law Seminar 3 credits
The course follows the traditional discipline of field-specific comparative law, focused not upon foreign legal systems as a whole but upon the treatment of specific and frequently controversial issues of current concern within health law and policy, particularly the application of bioethical principles in a host of differing legal systems. Within this format, we will present issues relating to: an individual’s basic right to health; organization of national health care systems; the role of legal institutions in allocating health resources; organ transplant barriers; the right to be free from medical negligence; consent to treatment; patient information and confidentiality; addressing and resolving medical grievance; abortion; human assisted reproduction; the right to die; assisted suicide and euthanasia; therapy and prophylaxis regarding HIV/AIDS; and research involving human subjects We begin with the acceptance of law as a statement of social policy to which both the sanction of public enforcement and enablement of the public fisc must be applied; then ask whether the ethics of the policy are sufficiently compelling and appropriate in light of economics involved in administering the policy and societal costs resulting from its general imposition. While the course will describe societal and economic contexts in which prevailing law is developed in different cultures, it will not attempt to present a complete picture of the health and bioethical law of any one of the discussed countries. The goal of the course is eminently pragmatic - to enable students to come to a better understanding of the ethical and practical underpinnings of law in developed jurisdiction as compared with corresponding statements of ethics and practical application of ethics in the developing world.
